Timeshare owners have found that getting out of a timeshare is made extremely difficult by many timeshare companies. If you have had enough of your timeshare membership, there are a number of options available to you in regards to getting out of the timeshare. Firstly, you should always check with your resort to see if they can help. You need to establish whether or not there are any specific criteria attached, which may include transfer fees and rules or relinquishment options.
Many timeshare companies do not offer any resale service, however, may provide an approved list of resale companies. Remember that a number of companies will let you hand back your membership, however, other companies may charge you for it or if your ownership is in perpetuity, you may need legal help from a specialist company such as Paxtex Consultants.
- Resale - Either you can sell your ownership privately, for example in timeshare sales forums, Ebay or seek help from timeshare resale companies. Please be careful with any buyer or organisation and make sure you feel comfortable with your decision. It is worth noting, you are still liable for financial and legal consequences if the resale company does not fulfill their promises.
- Surrender you membership - A number of resorts will allow you to surrender your timeshare membership providing the management fees are up to date. You will need to check and see if there are any other costs involved and familiarise yourself with the details, such as 'rules for unused points and weeks'. You will not receive any compensation, therefore, you will have to accept that you have cut your losses.
- Legal aid - If your timeshare is owned in perpetuity or it was purchased in Spain after 1999, you will need legal help as fighting a perpetuity contract is a very specialised task and you need legal help in order to win this battle. In addition, if you bought your floating week(s) after 1999, you might be entitled to compensation, as the Spanish Supreme Court declared these contracts as null and void.
